Terms of Service

These Terms of Service (“Terms”) govern your access to and use of VividlyReal (“VividlyReal,” “we,” “us,” or “our”) — our website, request-based fulfillment service, embeddable AI chatbot, custom-build engagements, and related AI-powered image and video generation features (together, the “Service”). By submitting a request or otherwise using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use VividlyReal. You don't need an account to submit a request through our public request form; that only requires a valid name and email address.

2. How the Service works

VividlyReal is offered in a few ways:

  • Request-based fulfillment — you submit photos and listing details through our public request form; we generate the staged photos and/or marketing video and deliver them to you.
  • AI chatbot — brokerages can embed an AI chatbot on their own listing pages that answers questions from their listing data, shows off staged photos and videos, and captures contact information from interested visitors.
  • Custom-build engagements — a brokerage or agency can inquire about a branded or fully-owned version of the platform, scoped and delivered as an individual project.

3. Payments

Request-based fulfillment — pricing is shown to you before you submit a request and depends on which services you select, how many properties you include, and, for a marketing video, which template you choose. After you submit, we email you an invoice and, once it's ready, a payment link. Work is delivered once payment is received.

Custom-build engagements — offered at a fixed, one-time price per plan, agreed and invoiced as part of that individual engagement.

4. The AI chatbot

If you're a brokerage using our embeddable AI chatbot, you're responsible for how you use the contact information it collects from your own website visitors, including compliance with any applicable lead-generation, telemarketing, or communications laws in your market. The chatbot answers strictly from the listing data you provide us and is designed to escalate to you whenever it's outside its depth — it isn't a substitute for your own judgment on any binding representation about a property.

5. Acceptable use

You agree not to use the Service to:

  • Upload photos or listing data you don't have the right to use, or that depict people without their consent;
  • Generate or distribute content that is unlawful, deceptive, or infringes on someone else's rights;
  • Upload, generate, or attempt to generate sexually explicit, pornographic, or otherwise NSFW content, or content sexualizing a minor — this applies regardless of the source photo, and we may suspend or terminate any account used to attempt it;
  • Misrepresent a property's real condition in a way that violates real estate advertising or disclosure law in your jurisdiction;
  • Use the AI chatbot to collect visitor data for any purpose other than following up about your own listings; or
  • Attempt to abuse, reverse-engineer, or overload the Service or its underlying AI infrastructure.

6. AI-generated content

Staged images, edits, and videos are produced by third-party AI models and are approximations, not guarantees of how a space will look in person. Some video templates include a built-in on-screen disclosure that a listing was virtually staged; for staged photos, the Service also offers an optional “Virtually Staged” watermark you can add at download time. Regardless of which mechanism applies, you are solely responsible for disclosing virtually staged media to prospective buyers or renters as required by MLS rules and applicable law in your market.

7. Your content

You retain ownership of the photos and listing details you submit through a request. By submitting them, you grant us a limited license to process that content (including sending it to our AI infrastructure providers) solely to generate your staged image, edit, or video and to operate and improve the Service. You own the outputs generated from your own submissions, subject to these Terms and the rights of any underlying model provider.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for accounts that violate these Terms, with notice where practical.

9. Disclaimer and limitation of liability

The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, VividlyReal is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including reliance on AI-generated output or on the AI chatbot's responses.

10. Changes to these Terms

We may update these Terms as the Service evolves. We'll update the effective date above when we do; continued use after a change means you accept the updated Terms.
